How Our Construction Agreements Work

Your written proposal or contract is the controlling document for your individual project.

2.1 Estimates Are Based on Available Information

Initial estimates are based on information available at the time of inspection and are not a guarantee of final cost. Hidden conditions (such as concealed damage behind walls, under flooring, or in foundations) may affect scope, materials, and pricing.

2.2 Written Agreements Control

The scope of work, materials, payment schedule, and any warranties or guarantees for your project are defined in your written proposal and/or construction contract. If there is any conflict between this Terms of Service and your signed agreement, the signed agreement controls for that specific project.

2.3 Change Orders

If you request additional work or if unexpected conditions are discovered (for example, structural issues, code upgrades, or water damage), we may issue a written change order describing the revised scope of work and any adjustments to cost or schedule. Change orders must be approved before additional work is performed.

2.4 Permits & Code Requirements

Where required, we will coordinate appropriate permits and inspections for the scope of work being performed. Code requirements may change over time and may require upgrades beyond the originally anticipated work. Any code-driven changes will be communicated and may result in revised pricing or scope.

How We Schedule and Bill for Projects

Clear expectations around payments and scheduling help keep projects moving smoothly.

3.1 Payment Terms

Payment terms, including any deposits, progress payments, and final payments, will be outlined in your proposal or contract. Timely payment is required to maintain your place in the schedule and to avoid project delays.

3.2 Late or Missed Payments

If payments are not made as agreed, we may pause work, reschedule your project, or, in some cases, terminate services. Any costs incurred due to late or missed payments (including storage, re-mobilization, or finance charges, if applicable) may be your responsibility as outlined in your contract.

3.3 Scheduling & Delays

Construction scheduling is dependent on labor availability, material lead times, weather, inspections, and other factors outside our control. Target start and completion dates are estimates only and may need to be adjusted.

3.4 Jobsite Access & Utilities

You agree to provide safe and reasonable access to the jobsite during normal working hours, and to ensure that necessary utilities (such as electricity and water) are available for the work being performed, unless otherwise specified in your contract.

What We Stand Behind

We aim for quality workmanship and clear expectations regarding warranties and limitations.

4.1 Materials & Substitutions

We strive to use materials specified in your proposal. However, due to availability and lead times, equivalent materials or brands may be used when necessary. Any significant changes will be communicated and approved through a change order where appropriate.

4.2 Manufacturer Warranties

Many products (such as windows, doors, fixtures, or flooring) carry their own manufacturer warranties. These warranties are provided by the manufacturer, not by Affinity. We will, when reasonably possible, assist you in accessing manufacturer warranty information.

4.3 Workmanship

Any workmanship warranties or guarantees offered by Affinity will be described in your written proposal or contract. In the event of a workmanship concern, you must notify us in writing within a reasonable time so we can evaluate and address the issue, subject to the terms of your agreement.

4.4 No Guarantee of Outcomes

While we work to deliver high-quality results, we cannot guarantee particular outcomes such as property value increases, resale pricing, or the performance of materials beyond what is stated in manufacturer or written warranties.

How We May Use Project Information

We respect your home and your privacy while also showcasing our work responsibly.

5.1 Project Photos

We may take before-and-after photos of projects for internal records, quality control, or marketing purposes. Where possible, we avoid displaying identifying information such as addresses or visible house numbers. If you prefer not to have photos of your project used in marketing, please let us know in writing before the project is completed.

5.2 Testimonials & Reviews

With your permission, we may share anonymized quotes or testimonials from your feedback. By providing a review, you grant us the right to reference it in marketing materials, unless you explicitly request otherwise.

5.3 Contact & Messaging

By submitting your contact information, you consent to receive communications from Affinity Construction & Contracting by phone, text, or email regarding your inquiry, estimate, or project.
